1296370855 52 Deputy Premier leaves Labor off campaign leaflet

The new South Wales Deputy Premier Carmel Tebbutt has excised the word “Labor” from campaign material being distributed in her seat of Marrickville in Sydney's inner west.

Ms Tebbutt is facing strong competition from the Green's candidate Fiona Byrne, who needs a swing of 7.5 per cent to win the seat.

The material, headlined 'Keep Carmel', underscores fears within Labor of retaining as few as 13 seats in the election on March 26.

The Greens MP David Shoebridge, says he expects the strategy will be widespread.

“We're going to see this across new South Wales. We'll see Labor candidates not mentioning Labor. We'll see Labor politicians speaking about their personalities rather than their policies,” Mr Shoebridge said.

“That will be a failure for new South Wales. we need to ensure that this state election focuses on the policies, such as privatisation, not the personalities such as Carmel.”

The ABC's calls to Ms Tebbutt have yet to be returned.

    It’s been a couple of days since the Patriots’ season ended in that surprise defeat to the Jets, and yet one thing has been playing on my mind more than the defeat itself.

    Patriots head coach Bill Belichick benched slot receiver Wes Welker for the first new England series of the game because he objected to comments Welker had made about Jets coach Rex Ryan.

    Now, the recent animosity between the two sides is well known, and Ryan and his Jets hadn’t actually been looking to defuse that during the run up to the game. Indeed, linebacker Bart Scott even singled Welker out for special attention when he took his own swing at new England.

    This makes me wonder if, on this occasion, Belichick—the man-manager’s man-manager—got it wrong on this occasion. He clearly expected his side to rise above the taunting and abuse, to act aloof from everything that the Jets were up to. but footballers are not like that.

    Football is a team game, a team game like no other. what other ball game features players who willingly accept that they might not touch a ball during their entire career, let alone during one single game? Players all over the pitch willingly sacrifice personal glory for the sake of the team.

    And the team that lives as a team tends to fight as a team. it is a sport played by high-testosterone and most of these men are not prepared to stand idly by and hear a teammate, or even the team itself, trash-talked by an opponent who they walked over just six weeks before.

    Belichick may have thought that he was showing Welker that no one man was above the team, but was he? Somehow, watching from a distance, the message that he gave off was, “I am not supporting you in this.”

    Is there a chance that a feeling that their coach was not behind them—however subliminally received—is partly behind the Pats’ lackluster showing on Sunday? Those few seconds that Welker was off the field could have been the most significant of the entire new England season.

      PLATTSBURGH — The Champlain Valley Athletic Conference volleyball all-star selections reflect the keen competition that marked its first season as a fall sport.Beekmantown, Plattsburgh High and Saranac, who wound up tied for first in the conference, also earned most of the postseason accolades. each had two first-team selections with Plattsburgh’s Olivia Harrigan voted Most Valuable Player for the 2010 season.Joining Harrigan on the elite team were Saranac’s Emily Heath and Kim Plumadore, Beekmantown’s Jenna Brault and Emily Wyand and Peru’s Abby Higgins.Saranac’s Joanne Johnson was named Coach of the Year.Three CVAC players earned All-State recognition from the new York State Volleyball Coaches Association.Harrigan and Brault both were named to the Fourth Team for Class B while AuSable Valley’s Kelly McBreairty received Fourth Team honors for Class C.

      Olivia Harrigan was the workhorse of the PHS offense for the second year in a row with her hard-hitting swing and the big hands block. this year, however, the 5-foot-11 senior captain never came of the court, showing versatility in the backcourt and as well as at the net.The middle blocker/middle hitter proved herself as the Most Valuable Player in the league by playing every aspect of the game. she once again dominated the net. As a three-year varsity player, she was the Hornets’ “go-to” player, leading her team in blocks and kills, with a kill percentage of 56 per match. she collected more than 300 kills throughout the season.When she wasn’t at the net causing havoc, her serve was dangerous when she got a run going. she was asked to bring her a game every set she played and she did that and more.The combination of Harrigan, Miller and McMahon gave Plattsburgh the upperhand in its 11-match winning streak as the Hornets went on to earn a piece of the CVAC Championship.

      An outside hitter for the Saranac Chiefs, Heath led the team in kills and kill efficiency. she combined an athletic jump with height and proved to be one of the most dominating hitters in the CVAC. When she was in the zone, opponents struggled to dig up her attack. Her attack skills were instrumental in leading the Chiefs to a share of the conference title.

      One of two starting setters for Saranac and a three-year starter, Plumadore brought experience and quiet leadership to the court. As a setter, she worked relentlessly to constantly better the ball. she served with pinpoint accuracy and led the team in both serving percentage and serve efficiency. she was a strong passer and anchored a three-person, serve-receive passing scheme.she demonstrated her love of the game through relentless effort to improve her skills both in season and during the off season.

      A dynamic athlete, Hillary Miller stepped into the crucial role of setter with very little experience and showed the league her talent on the court. she ran the Hornet floor like a veteran setter, impressing the opponent coaching staff in most matches. she led her team in assists and had the highest serving percentage for her squad. Voted by her teammates as their MVP, Hillary never left the floor all season showing her athletic versatility every time she took the court.

      Higgins, only a junior, was a third-year starting middle hitter and team captain. she led the team offensively in kills and defensively in blocks and digs.she was named to the Saranac Holiday All-Tournament Team in 2008 and 2009 as well as the 2010 Hannah’s Hope/Volley for Cure all Tournament Team. she was named to the CVAC All-Star team for the 2009-2010 season. Higgins is a member of the Varsity tennis team and is also involved in National Art Honor Society, National Science Honor Society, Key club, Varsity club, and the Student Mentor Program at Peru High School.

      Wyand’s superb passing skills, defensive consistency and ability to handle pressure brought confidence to the Beekmantown team. In just one season as the starting libero she closed out her high-school career with remarkable defensive stats of 461 digs, including a game high of 47. she did everything to not let the ball hit the floor and led the team with the highest dig percentages. Her defensive ability to read opponents attackers and anticipate where the ball would go gave the Eagles the ability to run a quick-tempo offense.she will be a difficult individual to replace as she has proven to the league what a libero is and the importance of a strong defensive game in volleyball.

      Taylor McMahon’s defensive play was the core of the Hornets backcourt play. a captain, she led the Hornets in digs, successful serve-receive passing as well as aces served. When McMahon came to the net, opponents were concerned about her sharp-angle hits and attacks from any place on the court. a quiet leader on the court, she made her presence known whenever she handled the ball. one of three PHS players who never left the court throughout the season.

      A three-year starter and an outside hitter for the Saranac Chiefs, Leitsch ranked second on the team in kills and kill efficiency. she anchored a strong passing team on serve receive and played left side defense.she could be counted on for a strong, consistent serve. she demonstrated outstanding leadership both on and off the court. Her warrior mentality and her work ethic both in season and out of season provided a catalyst that helped propel the Chiefs to a CVAC tri-championship.

      The strongest hitter on the Northern Adirondack team, she was also an excellent blocker and a great leaper. a well-rounded middle hitter, her serves were consistent.only a junior with two years of varsity experience, the Bobcats are lookin to introduce Durnin to the back row next season.

      McBreairty provided the heart and soul of the Class C and Regional 7-10 champion AuSable Valley Patriots. a senior, her positive attitude and diligent work ethic demonstrated strong leadership as well as her encouraging words on the court. she was a three-year starter and a very versatile player. this year she stepped up to run the offense as the setter. McBreairty finished the year leading the Patriots in assists, points, and aces. she will be sorely missed next year.

      Loya was the Northeastern Clinton captain and defensive specialist. she averaged 8.5 digs this season. When she wasn’t digging, Loya was the Cougars’ main passer in the offensive system.she was also a very dependable server in tough situations with only six service errors all season.

      Banker was a third-year starting setter and team captain for Peru. this season, the junior led the team offensively in assists. she was named to the Saranac Fall All Tournament Team and achieved CVAC honorable mention for the 2009-2010 season.Banker is a member of the Varsity tennis team and is involved in the National Art Honor Society, National Science Honor Society, Key club, Varsity club, and the Student Mentor Program at Peru High School.

      Brault brought three years of experience and leadership to the court. The senior captain started in every game as a middle hitter this season. she brought much confidence behind the service line, recording 132 service points and 42 aces this season. Her consistent tough serves challenged many of our opponents service receive. Offensively, Jenna was ranked with the highest kills (194) and was one of the leading blockers in the CVAC. Her ability to read the block and find holes in the defense opened up numerous offensive options for BCS. Jenna’s determination to improve and leadership has brought her great success in this sport. she has spent numerous extra hours in the weight room, attending middle hitter training sessions and watching film. these extras helped her become on of the top players in the CVAC and lead BCS to a championship season.         Lorraine Higgins — a new face in Galway East politics

        if there was ever a constituency which defined the term ‘boringly predictable’ it was certainly Galway East, a place even more beholden to repeating patterns and traditions than its sister electoral area Galway West.

        From 1981 to 1997, as a three-seater, Galway East returned without fail two Fianna Fáil, one Fine Gael. Since becoming a four-seater in 1997, the constituency has, without fail, returned two Fianna Fáil, two Fine Gael.

        There was only one exception, the 2002 General Election, when it went two Fianna Fáil, one Fine Gael, and one Independent, but even that was deceptive. the Independent in question was Paddy McHugh, a former Fianna Fáil member, so in a sense, 2002 was FF three (with one in disguise), FG one – a return to the days of 1937 to 1943 when, during its first incarnation as a four-seater, it was always FF three, FG one.

        Some of the faces may change but the trends were always the same – plus ça change, plus c’est la même chose as pretentious people like to say – with Fianna Fáil and Fine Gael taking the seats leaving precious little for anyone else. Indeed you have to go back to the 1961 election to find the last time a candidate from outside the ‘Civil War parties’ got a look in, with Clann na Talmhan’s Michael Donnellan.

        given that track record, Galway East is not a place where you would expect traditional voting patterns to be turned on their head, but these are extraordinary times, and maybe the unthinkable could happen – provided voters are not afraid to contemplate change.

        the current sitting TDs are Michael Kitt and Noel Treacy (Fianna Fáil) and Paul Connaughton and Ulick Burke (Fine Gael). Neither FG TD will be standing for re-election and speculation continues over the intentions of the two FF TDs. So we are guaranteed some new faces at least – but more substantial change may be in the offing.

        Fine Gael is running councillors Paul Connaughton jr and Jimmy McClearn and Sen Ciaran Cannon. Labour is running councillor Colm Keavney and Lorraine Higgins.

        Sinn Féin is likely to field a candidate, as will the Greens, although the latter party is finding it hard to recruit someone willing to endure the massacre that awaits the junior coalition partners.

        Fianna Fáil will hold its election selection convention for Galway East at the end of this month. So far councillors Mary Hoade and Gerry Finnerty have been nominated to stand. it is expected Dep Michael Kitt may allow his name to go forward. Dep Noel Treacy is also considering running again, but has made no firm decision yet.

        There is also speculation that councillors Tomás Mannion and Michael Connolly, and perhaps even former Galway East TD Joe Callanan could be standing as well. it is unclear whether the party will run two or three candidates.

        despite the uncertainty around Fianna Fáil it is possible to analyse the state of play in Galway East and make some extrapolations as to how things might play out in March’s General Election.

        the most recent Red C poll shows Fianna Fail on 14 per cent, Fine Gael 35 per cent, Labour 21 per cent, Sinn Fein 14 per cent, Green Party four per cent, and others 12 per cent.

        in a four-seat constituency the quota is 20 per cent which means Fine Gael is certain of one seat and can challenge for another; Fianna Fáil will have to fight hard to retain one of its two seats, with little hope of taking a second; and Labour could finally make the breakthrough to win one seat, unless the Independents get a lucky break. What is the likelihood of this happening?

        if Éamon Ó Cuív is the ‘sure thing’ of Galway West, Galway East’s equivalent is Cllr Paul Connaughton jr. his father was a long serving TD for the region and was also as popular as he was respected.

        Cllr Connaughton will benefit enormously from his father’s name and reputation, but since being elected onto the Galway County Council in 2009, he has proven to be a very hard worker, in touch with people and the issues that affect them, and a highly likeable individual.

        the real challenge for the party is to ensure he can bring in a running mate (McClearn or Cannon). the poll figures show it is possible, but only if there are solid transfers between all three candidates and a good supply of transfers from other parties.

        Based in Loughrea, Sen Cannon can take over the Ulick Burke vote and votes from the constituency’s southern region as a whole. his location may be to his advantage as generally Galway East TDs come from the Ballinasloe area, leaving other regions feeling a bit left out.

        given his past membership of the now defunct PDs, he may also attract that former vote and soft-Fianna Fáil votes, ie, those repulsed and disgusted with the party but unwilling to go as far as voting Labour or Sinn Féin.

        Cllr Connaughton will draw votes heavily from the northern region of Galway East, and Mayor McClearn may find himself overshadowed. he could end up being a sweeper, but his role as mayor and the rise in FG support mean his tally will be valuable in ensuring FG secure two seats.

        So it’s as you were for FG, but Cllr Connaughton shows a generational change is on the cards.

        in spite of all the wretched things this party has done to the State over the past 13 years – and over the last three in particular – Fianna Fáil will still have enough of a vote to take one seat. Granted their current figures show them four per cent below the quota, but people have not spent this long voting for the party to just run out on them now, and nobody contemplates Fianna Fáil returning with no seats.

        However the days of two Fianna Fáil seats look to be gone and the party will have to console itself with one seat. they can overcome 16 per cent to take one, but they will not have the numbers to swing two – the depth and breadth of anger against the party is too great.

        a Michael Kitt-led ticket will ensure the veteran politician will be returned, but if it is led by anyone other than the incumbents, Fianna Fáil will find its route to one seat a long and difficult one.

        a change is coming – Fianna Fáil to return with only one seat, a situation that has never happened in Galway East before.

        Labour/ Independents/ Sinn Féin

        Sinn Féin could put in a credible performance in Galway East. the party received a combined vote of 1,953 in the 2007 election and it has a county councillor in Dermot Connolly, but despite this and the party’s rise in the polls, the momentum still lies with Labour and the Independents.

        Independents are at risk in this election of being squeezed by the main parties as the focus will be on ‘Who do you want to be in Government?’ and, ‘do you want Cowen, Kenny, or Gilmore as next Taoiseach?’ – all questions which do not need an Independent TD in the answer.

        Galway (East and West) could buck this trend (especially Galway East) as the constituency looks set to have three strong Independents in the field.

        Although none has yet declared, there is strong speculation that councillors Tim Broderick, Seán Canney, and Pat Hynes will announce they are standing for election over the coming week/weeks. of these, the strongest contenders are Broderick and Canney.

        in 2009, Cllr Canney received an astonishing 3,273 first preference votes – one of the highest in the State – while Cllr Broderick polled 1,979 first preferences, an impressive tally for his first time out. Local election results are never an accurate barometer for general elections, but the figures are significant and should not be ignored.

        it may be too soon for Cllr Broderick, but if he goes, he may well lay down a marker for the future. Cllr Canney, though, has to be seen as a serious contender. There is a notable absence of candidates in the Tuam region – something his brother-in-law Paddy McHugh tapped into in 2002. Cllr Canney, with that field partly to himself, would be wise to do so again.

        However there is one man, and one party, that stands in the way – Labour and Cllr Colm Keavney.

        Traditionally Galway East is a wasteground for Labour but that seems to be changing. Indeed when seasoned political observers talk of Labour being in with a shout of credibly challenging for a seat in a constituency like Galway East, it is a sign of how much times have changed.

        Cllr Keavney’s 2007 election first preference result was a modest 1,747, but since then his profile and stock have risen considerably.

        Party leader Eamon Gilmore is originally from Galway East and has put great store in taking seats in Connacht, knowing the party has to if it is to make the breakthrough the polls are indicating.

        the rise in commuter areas with young families over the last decade – the very same people who have been let down by Fianna Fáil – will also help boost the Labour vote.

        That Labour is running a second candidate in Athenry’s Lorraine Higgins, shows the party believes there are votes to be had in the southern section of Galway East and not just in the north. certainly it is known that Ms Higgins has no intention of being a sweeper.

        interestingly Labour is not running a ‘railway strategy’ (where one candidate looks after the north of the constituency and the other the south) so candidates can campaign throughout the entirety of Galway East. this could risk splitting the vote and it remains to be seen if this was a wise call.

        in conclusion, Insider will make an initial prediction for Galway East of one Fianna Fáil, two Fine Gael, and Labour v Independents for the final seat. Expect a (partial) generational change, (mostly) new faces, and maybe even a party which has never won a seat there before. Galway East’s days of being ‘boringly predictable’ are numbered.

          We let our dog out each day to relieve himself but he doesnt do it on the same spot every time. we have a gated/fenced house and sometimes, our dog likes to go to the corner that's near the neighbors. now, our lawn is not full of feces, we pick it up daily, but not right after the dog poops.

          It happened to rain today and my neighbor comes over threatening to call the cops to take our dog away because there was feces outside. We've never had a problem with this neighbor before but he seemed to have been enraged even before talking to us about it. Normally, I would have said sorry and picked up the mess myself but he kept swearing at me and my family so I told him he had to leave. As he was getting to his side of the fence, he was screaming at the people walking by to look at the **** that was in our lawn so I told him to just stfu. He turned around and angrily walked towards me as if he wanted to take a swing. I went ahead and closed the gate and told him I would call the cops if he tried to get in or take a swing at me.

          Does anyone have any legal advice on this issue? again, our lawn is not full of feces and we usually clean up the next day.

          If it's in your lawn, and their aren't any city laws against it, he has NO right to be upset with you!!!! let your dogs poop as close to the property line as possible! ;)

          omg it your yard and you can do what you want on it let him call the cops you won't get in troble one time my neibore went to my other nebores house and got all mad just because the dog was braking a a racoon. hope everytihg gets better if not call the cops

          If you clean it up every day there is nothing he can do That's why we moved to the country to get away from people like that..

          It's YOUR lawn, as the other answerer said. There's nothing illegal about allowing YOUR dog to relieve themselves on YOUR lawn. now if your dogs were continuously barking, then that'd be a different story. Your neighbor is being a bad one, and a childish person at that. As long as your dogs don't bark or poo on their lawn, your fine.

          He has no right to do anything to you, or even FORCE you to pick it up – it's your lawn. If he hit you, he'd be in jail.

          I'd call the cops and make them tell the guy that he has no right to tell you to pick up feces from your own yard.

          He's just being a total JERK!

          He sounds like a drunk idiot.

          If it is on your yard and fenced in, not to mention you pick it up! I see no way for this person to do anything to you. If he bothers you again and again I would call the cops for harassment. Legally he was trespassing on your property and you have the right to tell him to leave and if he doesn't again you have the right to call the cops and have him removed.
          He can't do anything to you that I know of unless your dog is noisy or has bitten someone. Just keep an eye on the guy he sound unstable and I wouldn't put it past this someone to do something to the dog if he was that enraged.
          Check local law, if you pick up the poo then not really a legal problem for you.

          This guy has anger issues and obviously something else wrong with him.

          Your dog is allowed to poop in your yard. you know it and I know it. Heck I have 5 dogs. we do our best to scoop the poop daily. but honestly, even if we do it daily, there's some we miss and they poop AFTER we scoop!

          If he gets abusive again call the police. He's in the wrong. Just make sure your dog never poops in his yard.

          I'd also see if you couldn't talk to his wife? maybe she could calm him down…

          He can't take your dog away. That's not possible for poop. they don't even take dogs away from people who abuse them. Just keep an eye on the guy and be careful ok? He sounds like a nutjob.

          And don't let the dog out alone. God knows what an idiot like that would/could do to your dog. you certainly don't want him feeding your dog something poisonous.

          PS. I'd document everything… what happened, date it etc…. from now on.

          Do you live in an HOA?

          Just ignore him. He is the one being a complete a s s. As long as you clean up your yard on a regular basis you're good.

          If it's on your lawn, it's not his business. I would refrain from calling him any more names though and call the cops the next time he comes on your property. in fact, I might report this incident to the police anyway for future reference.

          Dude's having a bad day. I'd let it go and hope he apologizes, but if not, oh well (unless you're friends or something). You're not in the wrong at all.

          I'm going to take the other side on this.

          Legally, dog poop is considered a health hazard in many cities. Leaving copious amounts of it to fester may be against the law and against health code violations.

          Also, if it's near the property line, then he can probably smell it. this may also be against the law as you are promoting conduct that affects his house value and quality of life.

          While you think that you've never had a problem with it, perhaps he sees it as otherwise. one pile of poop isn't going to cause that kind of reaction. Perhaps his house is a dumping ground for poop (not necessarily from your dog), or perhaps there are other issues with your dog outside of the poop. like he barks alot, is left outside to rot, has growled at his family ,etc. or, perhaps there are other issues with your family in general. Loud music, messy yard, trash all over, etc.

          If this were my neighbor, I'd take a look around at my part as a neighbor, clean up whatever needed to be cleaned up, and then wait a few days and approach him. let him know that you are sorry about the poop and that it won't happen again. Tell him "I hadn't realized it was such a problem that it was building up for that kind of reaction." Hand him your phone number and then say "Here's my number. If you ever see this again, please do not hesitate to call me to let me know and I'll be happy to pick it up."

          Keep friendly with your neighbors. The last thing you want is an ugly pi$$ing contest with them.

          Of course, if your neighbor is a problem in general, then clean up the poop and go out of your way to not cause any problems. The second he causes anything, call the cops.

          Added: why would I get thumbs down for stating the law? good god – all 12 year olds today?

          That's right, I forgot it's a holiday.

          I would immediately call the police and file a complaint against this neighor for trespassing, threatening you, and being abusive.

          If the dog poop is on your lawn it is none of his business. If there are laws in your area saying it must be cleaned up immediately, then you are at fault, but your neighbor is so far out of line that he would worry me.
          Call the police and go on record as being threatened by this man.

          It sounds very much as if there is something else wrong in his life, and you just happened to catch it that time.

          If there is any further contact, I would call the police, and tell them he has threatened you. Dog poo not withstanding, it is not a license to threaten you well being. What he has already done qualifies as assuault. you could already report him.

          Here's hoping that he backs down, and fixes whatever is his personal problem, or thinks next time before it occurs to him to go after you.

          And I would put an extra piece of screening inside youur fence, as extra insurance.

          if the poop is all on your property only, and it isn't excessive, he doesn't have the right to come over and threaten you. however, i sympathize with him. i have neighbors who let their dogs crap everywhere, and won't pick it up everyday. even though technically, it isn't on my property, it is pretty damn close, and it annoys me to see that they don't always pick it up. i know its not that big of deal to clean up after them since i have a dog too, but i think just as a courtesy, just clean it up right after he poops. it makes it easier for you, cuz then you're only picking up 1 poop at a time, rather than it being a whole chore (cuz it does pile up after a day or 2!), and it might makes things a little better between you and your neighbors. but again, since it is on your property, and it isn't all over your lawn as you said, he can't really say or do anything about it. but your neighbor is a jerk though, and i know how u feel.

          You can call the cops just for him threatening!!! you may want to think about it- they'll just come over and talk to him, and basically just tell him to leave you alone. then if he does it a second time, call immediately.

          They won't take your dog away for one pile…. or even two or three. There's nothing he can do to you– the worst is a cop would come to your door, and remind you to p.u.t.p. -( pick up the poop, as our land lord says it.) :)

          I think you are unlucky enough to have one of those nasty neighbors who won't be happy no matter what you do. I would just continue on about my business. He would have to prove that it was a horrible nuisance, or that caused him damages somehow.

          I don't think your neighbor has any right to yell about where your dog poops. I would document his crazy behavior. Also, be sure that your dog is up to date on shots and has a license just in case he tries to turn you in for something. My mom's neighbor called the police on her because he said her dogs were barking. The dogs were never outside unsupervised. Anyway, it got really crazy and everytime she took her dogs out, he would play "Who let the dog's out" really loud and try to upset the dogs. then he threw something over the fence and the dogs got sick. she finally ended up moving because he was a psycho!

          ya it seems stupid but you can actually get in trouble if they can see your back yard from their windows. we just got a puppy and it was really cold out one day so i didnt pick it up he went twice that day and the neighbors freaked out and said they were going to report us. I thought they were bull shitting so i called the city and because they have a back porch that overlooks our yard we can get slapped with a fine.

          Seems to me if your dogs poop in your yard then it's your business … especially since you clean it up within a day or two. I'm not sure why this neighbor would go off on you like that and shouldn't have any right to do so.

          Next time he does that (if there is one) just keep calm and if he threatens to call the cops, offer to do it for him and go inside, get your phone and start dialing. Put your phone on speaker and walk just outside your home to explain the situation to the cops so your neighbor can hear.

          it's your yard and it's fenced so he cannot do anything. if continues to bother you and comes on your property i would call cops,don't argue with him let the cops handle it.

          i would also keep an eye on your dog when he is out doing his business. you never know what a neighbor like this might try to do to your dog and if no one sees it it is your word against his whether you had problems with him before or not.

          Let him vent, it's your yard, your dog, and if you want to wait to pick up the poop (I don't always pick up right away either), that's your right as a home owner. Next time he comes over and starts to rant, laugh at him and say calmly "OK" and walk away.

          You should have let him hit you. you could have put him in jail. Next time he acts threatening, call the cops. And if he continues to act like that, then have a restraining order slapped on him (one that makes him go inside his house whenever you are in your backyard).

          If he doesn't like it then he should plant a bush to block his view. I just love it when old people start telling neighbors what they can/should do with their own property.

          Per the general consensus, this is nothing illegal or even generally offensive about letting YOUR dog poop in YOUR yard. now, if the yard wasn't fenced and he was pooping a little too close to the property line, that's bad. If you just let the poop sit day after day and it was starting to stink up the place, that would be cause for complaint. but there is NOTHING wrong with what you're doing.

          If he approaches you so enraged again, you should seriously call the cops. it sounds like he may hurt you over a conflict that he is WRONG, WRONG, WRONG about.

          You should have called the police rather than say anything to him and when they got there pointed out that the poo m,ay have come from someone elses dog since it was outside your fence.then made it known that you will be wanting to press charges against this idiot the next time he threatens you or your animals in any way shape or form.

              THE COACHES UIC: Howard Moore is in his first season as a college head coach. Moore, 37, comes to UIC after spending the previous five seasons as an assistant coach at Wisconsin, his alma mater, under head coach Bo Ryan.

              Moore joined the Badgers staff in 2005 and helped lead them to the NCAA Tournament in each of his five seasons in Madison. the team advanced past the first round of the big Dance in each of the last four seasons and produced a memorable Sweet 16 run in 2008.

              With Moore on the bench, Wisconsin posted three of the top-five winningest seasons in school history, including an historic 2007-08 campaign that saw the Badgers win a school-record 31 games en route to big Ten regular season and tournament championships.

              SCOUTING THE FLAMES UIC is 5-12 (0-5 Horizon) on the season, including a 1-6 record in true road games. the Flames are coming off a 72-69 loss versus visiting Detroit last Saturday.

              Senior guard Robo Kreps is leading the Flames offensively, scoring 15.5 points per game — he has also dished out a team-high 58 assists in his first full season running the point. Minnesota transfer, senior forward Paul Carter is averaging 14.9 points per game, while also leading the Flames in rebounding with 8.2 caroms per contest, second-best in the Horizon League. Kreps currently ranks seventh in the conference in scoring, while Carter ranks ninth.

              In Horizon League play, Carter ranks sixth in the conference in scoring (16.0 ppg) and second in rebounding, at 8.6 caroms per game. he is averaging 6.2 defensive rebounds per contest in UIC’s five Horizon League games.

              UIC is averaging 62.9 points per game, and allowing its opponents to score 67.8 points per contest. on the road, the Flames are averaging 59.1 points per game, and are being out-rebounded by their opposition, 35.6-31.7. In Horizon League play, UIC leads the conference in offensive rebounds (14.4 rpg), while ranking second in overall rebounding margin (+5.6).

              SCOUTING THE PANTHERS Milwaukee, who dropped a 69-64 decision at Green Bay on Jan. 8, is 8-9 on the season, including a 3-3 record in Horizon League play. the Panthers are 4-3 at home this season, including a convincing 76-52 win over visiting Butler on Jan. 3.

              Senior guard Tone Boyle is leading Milwaukee offensively, averaging a team-high 12.9 points per game — Anthony Hill (12.6 ppg) and Tony Meier (11.1) are also both scoring in double figures. In Horizon League games, four players are averaging double figures in scoring, led by Hill’s 13.8 points per contest.

              Hill is also averaging 6.6 rebounds per game, the fourth-best mark in the Horizon League. Kaylon Williams’ 4.6 assists per contest rank third in the conference, while Meier ranks third in both field goal percentage (.542) and three-point field goal percentage (.439).

              In Horizon League action, the Panthers are drilling 8.5 threes per game, which ranks second overall. Milwaukee ranks ninth in field goal percentage (.407) and field goal percentage defense (.471), and 10th overall in three-point field goal defense (47.6 percent).

              DOUBLE TROUBLE Senior forward Paul Carter leads the Flames with six double-doubles on the season, including three-straight in Horizon League play … Carter has tallied double dips against the College of Charleston (11/20/10), Toledo (11/28/10), Illinois State (12/11/10), Cleveland State (1/1/11), Wright State (1/6/11) and Detroit (1/8/11) … he is second in the Horizon League in double-doubles, behind only Detroit’s Eli Holman (8).

              THE SERIES Milwaukee leads the all-time series against UIC, 34-22. the Panthers defeated the Flames three times last season by a total of 15 points, including in the first-round of the Horizon League Tournament.

              UIC’s longest-standing rivalry within the Horizon League, the series between the Flames and Panthers began in the 1955-56 campaign, with UIC claiming a 57-47 home win. Milwaukee rolled off wins in the ensuing five meetings, and also defeated the Flames 10-consecutive times from 1970-80.

              The Flames won four-straight in the all-time series between the 2006-07 and 2007-08 campaigns, but Milwaukee has won the last five meetings, dating back to the 2008-09 season.

              CLOSING THE GAP UIC enters the third full week of Horizon League play with a 0-5 record, the only team in the conference yet to record a victory. but the Flames haven’t been far off in their losses – three of those setbacks have been one-possession games, including last Saturday’s 72-69 loss against Detroit. In fact, four-of UIC’s losses this season have come by just two points — the Flames are 2-5 this season in games decided by five points or less.

              CLIMBING THE CHARTS Robo Kreps scored a team-high 21 points at Cleveland State (1/11/11), his sixth performance this season with 20 or more points. In the process, Kreps passed Tim Anderson (1980-84) for 10th on UIC’s all-time scoring list (1,369). Additionally, with his two assists against Oregon State (12/22/10), Kreps became only the third player in school history to score 1,300 or more points, and dish out at least 200 assists, joining Kenny Williams (1990-94) and Josh Mayo (2005-09).

              CONTROLLING THE BOARDS as mentioned, UIC has out-rebounded 11-of its 17 opponents this season, including the last six, and all five Horizon League foes. In conference play, the Flames lead the league in offensive rebounds (14.4 rpg), while ranking second in rebounding margin (+5.6).

              KREPS IN HORIZON LEAGUE STATS there is no shortage of Robo Kreps mentioning in the up-to-date Horizon League stats (all games). Along with leading the league in minutes played (37.5 mpg), the preseason All-Horizon League Second Team honoree ranks seventh in the conference in scoring (15.5 ppg), seventh in assists per game (3.4), third in free throw percentage (.843), fifth in three-point field goals per game (2.1), ninth in three-point field goal percentage (.409) and eighth in defensive rebounds (3.9 rpg).

              CARTER’S CAROMS Senior forward Paul Carter has been the overwhelming catalyst for the Flames’ success on the boards this season. the Horizon League’s second-leading rebounder (8.2 rpg), Carter has led the Flames in rebounding 10 times, and also grabbed nine or more caroms on nine occasions.

              THE 70-POINT PLATEAU UIC’s improved defensive effort has had a direct result on its won-loss fate as the Flames transition into Horizon League play. the magic defensive number could very well be 70: When the Flames allow their opponent to score 70 or more points, they are 0-8 on the season.

              CARTER’S JOURNEY First-year head coach Howard Moore and the UIC men’s basketball program received some great news in late September, when Minnesota transfer Paul Carter was granted a legislative relief waiver by the NCAA, allowing him immediate eligibility at UIC for his senior season.

              Carter served as Minnesota’s Sixth Man the past two seasons, helping the Golden Gophers reach a pair of NCAA Tournaments.

              Carter transferred to UIC with one year of eligibility remaining to be near his sister, Bria, who was diagnosed with osteosarcoma, a form of bone cancer, last winter. Since Carter joined the Flames, Bria has completed chemotherapy, received a temporary prosthetic leg after amputation, and started her high school career at King High School in Chicago this semester.

              Carter comes from a strong sports family. Ron Carter, Paul’s father, was drafted by the Los Angeles Lakers in 1978, and his older brother, Ron III, was an All-American triple jumper at California State-Long Beach.

                  Massachusetts will lose congressional and Electoral College seats, according to 2010 Census figures released Tuesday, with the state's modest population growth outpaced by the nation's South and West.

                  The state is also likely to receive a smaller share of the $400 billion in federal aid disbursed annually, thanks to its population increase of just 3.1 percent, from 6,349,097 residents in 2000 to 6,545,919 this year. in contrast, the South jumped 14.3 percent and the West 13.8 percent.

                  "I don't think any of us are surprised by it," state Rep. John Fernandes, D-Milford, said of the swing in political power. "Disappointed, sure. (But) this is not a new trend."

                  The numbers mean Massachusetts will lose one of its 10 congressional seats in the 2012 election. but the impact on MetroWest, Milford and other regions is not yet known because the Legislature now needs to redraw voting districts at both the state and federal levels.

                  in a state that gave rise to the word "gerrymander," that has not always gone smoothly. former House Speaker Thomas Finneran famously pleaded guilty to obstruction of justice in a civil rights redistricting case brought after the last Census, and legislators are still trying to exorcise his ghost.

                  "Frequently that's the perception, if not the reality," said state Rep. Alice Peisch, a Wellesley Democrat whose district includes Weston and part of Natick, "that political considerations are the driving factor."

                  already, the arms of five winding congressional districts meet in MetroWest, while Milford and neighboring towns are merged into the 2nd district with Western Massachusetts communities.

                  Milford's congressman, Democrat Richard Neal of Springfield, D-2nd, released a statement through a spokesman Tuesday backing the preservation of two districts west of Worcester.

                  Other local members of the Massachusetts delegation released statements, too. U.S. Rep. Niki Tsongas, D-5th, said she wants to maintain her borders "to the greatest extent possible," focusing on the Merrimack and Concord river valleys but also keeping towns like Sudbury and Hudson.

                  Rep. Jim McGovern, D-3rd, pledged to work for whomever he might represent, while Rep. Ed Markey, D-7th, put out a similar message.

                  "Day in and out, this Massachusetts congressional delegation is and will continue to be a powerful force here in Washington, as they always have been," he said.

                  At the congressional level, forming nine districts could pit Democratic incumbents against each other in primaries, though McGovern and others have mentioned the possibility of Rep. Barney Frank, D-4th, or Rep. John Olver, D-1st, retiring. A few might also choose to run against Republican U.S. Sen. Scott Brown.

                  At the state level, legislators may worry about losing their political bases or the return of the old, unofficial system of leadership punishment for political slights.

                  but several area legislators believe those days are past, and spoke about respecting minority rights and placing towns together in a cohesive and logical fashion.

                  "They're going to be doing this right, and they're going to be talking to a lot of people," Fernandes said. "I have a strong sense this will be an open process."

                  A special legislative committee, likely led by state Rep. Michael Moran, D-Brighton, and state Sen. Stanley Rosenberg, D-Amherst, will handle redistricting. The remaining 20 House seats and six Senate spots on the committee are expected to be filled early next year.

                  any proposal needs the backing of the full Legislature and the governor, with the Census bureau planning to release detailed state-by-state data starting in February.

                  Peisch was not in office during the last redistricting, but said she has received assurances of openness and transparency this time around, with legislative plans for a hearing in each congressional district and a special website.

                  "It remains to be seen how it plays out, but they've certainly started on the right foot," she said.

                  Last year, Peisch and state Sen. Richard Moore, D-Uxbridge, filed similar bills calling for an independent redistricting commission. Both required amending the state Constitution and did not move forward, though Peisch said hers was simply meant to improve the existing process given time constraints.

                  an independent commission, state Republican Party Chairman Jennifer Nassour said, would ensure redistricting "is fair, transparent and does not result in another embarrassing federal investigation."

                  Fernandes disagrees, believing an elected Legislature should make the decisions and face accountability.

                  but state Sen. Jamie Eldridge, D-Acton, and Secretary of State bill Galvin favor a hybrid: a citizen's advisory committee that submits a plan to the Legislature for approval. Eldridge is considering filing such a bill next term.

                  Given the need for redistricting, Eldridge said he hopes the committee avoids splitting towns into different districts.

                  He is also demanding more transparency, he said, and believes the process provides an opportunity to restore the faith of a disillusioned public.

                  "I think that's an important moment for the Legislature to get it right," he said.

                  PITTSTON — Christmas came early for Kaleb Barnes.

                  Good thing, too.

                  The 4-year-old Pittston boy needed a fun place to play where he wouldn’t be exposed to too many germs. He was diagnosed in April 2009 with acute lymphoblastic leukemia — a cancer of the white blood cells that normally fight infection.

                  What better toy than a outdoor swing set, where he can breathe fresh air while playing with friends?

                  As a service project, Boy Scout Troop 613 in West Gardiner built Kaleb a swing set and slide with a canopy covered tree house, rock climbing wall and ladder.

                  Kaleb’s mom, Melissa Ambrose, 27, said she is still in shock.

                  "this is so exciting," Ambrose said Friday. "We’ve been talking about (a swing set). Because of his health condition, we’ve tried to create a controlled environment for Kaleb and make our home as fun and as exciting for him and his friends. And this is perfect."

                  She said Kaleb was shy at first, when the Boy Scouts arrived at their home on Stage Road to piece the swing set together.

                  "when he first saw it, he was very quiet," she said. "But within 10 minutes, he was running around. It was pretty close to dark when he came inside and asked if he could call and invite some kids to come over. It’s just, we’ve got to be real careful because of his immune system."

                  Kaleb also has a little brother — Emmet, who will be 2 years old in January — who plays with him on the swing set, she said.

                  Noah Berlew, 13, of Pittston came up with the idea. He said the materials cost $493, much of which was funded by a bottle redemption center the troop runs at the West Gardiner transfer station, he said.

                  Berlew said it was a great experience for the whole troop.

                  "It felt pretty good once he came out and was all thrilled with stuff," Noah said. "He was scared at first, but then he warmed up to me."

                  Noah’s mother, Becky Berlew, said the troop built the swing set in her basement.

                  "we had to watch the weather reports," Berlew said. "But we had a big truck and trailer come into my door yard Saturday afternoon and pick up the parts and drive it to their house."

                  Jewett Builders Inc., of Pittston, provided the truck to haul the swing set to Ambroses’ yard, where it was assembled.

                  Others who helped build the swing set include scoutmaster Jeff DeHart and his son, Eli; Marc Plaisted, committee chairman and his son, Harris; and Terry Handy, committee member, and his son, Jake.

                  "I think it was a good experience for the boys," said John Bucci, troop leader. "they worked for the money we have in the troop and we happened to be able to afford it. We’re in West Gardiner, but as far as I’m concerned, this is a local boy. That’s what Boy Scouts is all about: doing good and following deeds and codes that they live by."

                  Ambrose said Kaleb has been in and out of the hospital since he first got sick in February 2009. Doctors were finally able to diagnose the cancer, in April 2009, after he became ill again. He is currently in a three-year treatment program.

                  "this is the longest period of time he’s been home since September," she said. "He’s so susceptible to things, a cold or anything else going around. It’s been a very emotional time for us.

                  "we didn’t know these people and they totally surprised us. It’s really amazing. this is something special for Kaleb."
